"Tag Your Green" Green Project Contest on MAKE Official Rules
This promotion is intended for play and participation in the 50 United States and the District of Columbia only and shall be construed and evaluated according to the laws of the United States. Please do not participate if you are not a legal resident of one of the 50 United States or the District of Columbia and located in the United States at the time of entry.
Important: Please read these Official Rules before entering the "Tag Your Green" Green Project Contest (the "Contest") sponsored by Maker Media, a division of O'Reilly Media, Inc., ("MAKE") and General Electrics ("GE") (each a "Sponsor", and collectively "Sponsors"). By filling out an online entry form, you agree to be bound by these Official Rules. You may not submit an Entry unless you agree to these Rules. You agree that participation in this Contest and/or submission of an Entry in the Contest constitutes your full and unconditional agreement to these Official Rules and Sponsors' decisions, which are final and binding in all matters related to the Contest.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. CONTEST OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA WHO ARE OF THE AGE OF MAJORITY IN THEIR STATE OF RESIDENCE AT THE TIME OF ENTRY (19 OR OLDER IN AL AND NE, 18 OR OLDER IN ALL OTHER STATES). VOID OUTSIDE THE UNITED STATES AND WHERE OTHERWISE PROHIBITED BY LAW.
Eligibility: The Contest is open to legal residents of the 50 United States or the District of Columbia who are of the age of majority in their state of residence at the time of entry. Employees, contractors, directors and officers of Sponsors, their respective parent, affiliates, subsidiaries, distributors, sales representatives, retailers, and advertising, promotion and judging agencies and all other service agencies involved with the Contest, and members of the immediate family (spouse, parent, child, sibling and their respective spouses) and household of each such party are not eligible to participate. Void where prohibited by law. Contest is subject to applicable federal, state and local laws and regulations.
How to Enter: Contest begins at 12:01 a.m. PDT on November 16, 2010 and will end at 11:59 p.m. PDT on December 31, 2010 (the "Contest Period"). During the Contest Period, entrants are invited to enter their "green project" in accordance with the requirements set forth in these Rules. To enter, go to the Contest landing page at www.makezine.com/tagyourgreen, fill out the required information on the contest entry form, including your name, nickname, project title, goals, description, email address and any links to images, videos, schematics, or more information about your project, and choose one of the five project categories: renewable resources, recycle, conserve, transport, or other (collectively "Project" or "Entry"). Entrants must have a valid email address. Automated entries are prohibited, and any use of automated devices will cause disqualification. Limit one (1) Project per person/email address. Participants may not enter with multiple email addresses nor may entrants use multiple identities to enter multiple times. Any entrant who attempts to enter with multiple email addresses under multiple identities or uses any device or artifice to enter multiple times will be disqualified and forfeits any and all prizes won, in Sponsors' discretion. Entries must be received during the Contest Period to be eligible for the Contest. All entries become the property of Sponsors and none will be returned. Should multiple users of the same e-mail account enter the Contest and a dispute thereafter arise regarding the identity of the entrant, the authorized account holder of said e-mail account at the time of entry will be considered the entrant. "Authorized account holder" is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Please see the privacy policy located at http://oreilly.com/oreilly/privacy.csp for details of Sponsors' policy regarding the use of personal information collected in connection with this Contest.
Contest Entry Requirements: Projects must be in English. To qualify as a "green project", a Project must aspire to make a positive environmental impact (i.e., reduce energy usage in the home, a mode of transportation that relies solely on renewable energies, etc.) You may design a Project or you may enter a Project that you have already created provided it has not previously won any awards. You may submit a diagram, drawing or essay explanation of your Project by providing a link to this content in the "link" section of the Contest Entry form. Entries cannot: (a) be sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, or contain nudity; (b) promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message; (c) be obscene or offensive, endorse any form of hate or hate group; (d) defame, misrepresent or contain disparaging remarks about Sponsor or its products, or other people, products or companies; (e) contain trademarks, logos or trade dress owned by others, or advertise or promote any brand or product of any kind, without permission, or contain any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses; (f) contain copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media or musical "samples" other than the musical tracks provided) without permission; (g) contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, other than you, without permission from the third-party or a parent or legal guardian if the third-party is a minor; (h) communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate; and (i) cannot depict, and cannot itself, be in violation of any law. Projects: must be the original work of the entrant; may not have won previous awards; must not infringe third-party rights, and must be suitable for publication (i.e., may not be obscene or indecent). Sponsors reserve the right to waive the Contest entry requirements set forth herein in its reasonable discretion. Sponsors reserve the right, in their reasonable discretion, during or upon completion of the Contest Period, to request that any entrant resubmit his or her Entry that fails to comply with the Contest entry requirements.
Winner Selection: Projects will be posted on Sponsor's website at www.makezine.com/tagyourgreen beginning 12:01 am PDT on November 16, 2010 through 11:59 pm PDT on December 31, 2010 ("Voting Period") for public voting based on the following criteria: inspiring and creative Project idea that aspires to make a positive environmental impact, and effective execution of the Project idea based on the Project goals ("Judging Criteria"). The entrant with the Project that receives the highest number of votes during the Voting Period will be the potential Grand Prize winner, subject to verification. After the Grand Prize Winner, the Project in each category with the most votes will be the Runners-Up respectively, subject to verification. There will be a total of five (5) Runners-Up. In the event of a tie, a qualified panel of three (3) judges selected by MAKE will judge the tied Projects based on the following criteria: 40% creativity and originality of idea, 30% positive environmental impact, 30% execution and documentation of the Project. Sponsor's decisions are final and binding in all matters related to this Contest.
Voting: Limit one (1) vote per person/email address per Project. Voters may vote for an unlimited number of Projects, however voters may only cast one (1) vote per Project. Any attempt by entrant and/or his/her family/friends to vote more than the number of times authorized herein using multiple names or email address and/or any other fraudulent mechanism, as determined by Sponsor in its sole discretion, shall give Sponsor the right to disqualify entrant in its reasonable discretion.
Winner Notification: Potential winners will be notified by email on or about January 7, 2011. Sponsors are not responsible for any change of entrants' mailing address, e-mail address and/or telephone number. Potential winners are subject to verification, including verification of age. If a potential winner is found not to be eligible or not in compliance with these Official Rules, or if prize notification or any prize is returned as undeliverable, the potential winner will be disqualified. In the event that a potential winner is disqualified for any reason, any prize will be forfeited, even if the disqualified potential winner's name may have been publicly announced. Winners may be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release, within 15 days of attempted notification or prize may be forfeited. Failure to respond with the required information within this time period as required pursuant to these Rules may result in disqualification and selection of an alternate winner.
Prizes: Grand Prize (1): Trip for Winner and one guestto one 2011 Maker Faire of winner's choice. Winner may choose to attend either (i) Bay Area Maker Faire in San Mateo, California on May 21-22, 2011, or (ii) Maker Faire Detroit in Dearborn, Michigan on July 30-31, 2011; or (iii) Maker Faire New York at the New York Hall of Science in Queens, New York, in September 2011 (exact dates TBD), and winner will also have the opportunity to award 5 green ribbons to the top 5 green maker projects of his or her choice at the Maker Faire event. Prize includes: round-trip, coach class air transportation for Winner and one guest from a major commercial airport near winner's home within the U.S. to San Francisco International Airport (for Bay Area Maker Faire), Detroit Metropolitan Wayne County Airport (for Maker Faire Detroit) or John F. Kennedy International Airport or LaGuardia Airport (for Maker Faire New York); one (1) double occupancy standard hotel room for two (2) nights; two (2) weekend passes for winner to the Maker Faire event selected by winner. Approximate retail value ("ARV"): $1,500. Actual value of trip may vary based on point of departure and airfare fluctuations. Any difference between stated approximate retail value and actual value of Prize will not be awarded. Selection of airline and hotel are solely within Sponsor's discretion. Meals, gratuities, luggage fees, incidental hotel charges and any other travel-related expenses not specified herein are the sole responsibility of winner. All travel must be taken on dates specified or prize will be forfeited and may be awarded to an alternate; no alternative travel dates are available. Exact travel dates and arrangements subject to availability. Winner and travel guest must travel on same itinerary. Travel guest must sign and return a travel release before any ticketing of travel occurs. A minor may accompany winner as a travel guest only if the winner is the minor's parent or legal guardian. Winner and guest must have all necessary identification and/or travel documents (e.g., a valid U.S. driver's license) required for travel.

Runner-Up Prizes (5): The Runner-Up in each project category (Conserve, Recycle, Reneable Resources, Transport, and Other) will receive one (1) 1-year subscription to Make: Magazine (ARV $34.95), one (1) Autographed copy of "Made by Hand" by Mark Frauenfelder (ARV $25.95), one (1) Makers Notebook (ARV $19.99), one (1) SunMod Kit (turn your remote control into a solar-powered device) (ARV $18.00), and two (2) day passes to Maker Faire (ARV $50.00). Total ARV of each runner-up prize: $148.89.
Total ARV of all prizes is $2,393.34 as of the date of printing of these Official Rules. The difference in value of prize as stated herein and value at time of prize notification, if any, will not be awarded.
Prizes are not transferable. No cash redemptions. No substitutions or exchanges of prizes will be permitted, except that Sponsors reserve the right to substitute a prize of equal or greater value for any prize that becomes unavailable. Unclaimed prizes will not be awarded. Limit one (1) prize per person/household/email address. All taxes are the sole responsibility of winners. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTBILITY OR FITNESS FOR A PARTICULAR PURPOSE). ACCEPTANCE OR USE OF PRIZE IS AT SELECTED WINNER'S OWN RISK.
General Conditions: BY SUBMITTING AN ENTRY, YOU ACKNOWLEDGE THAT YOUR ENTRY MAY BE POSTED ON THE WEB BY SPONSORS, IN SPONSORS' DISCRETION. By submitting an Entry, you hereby warrant and represent that the Entry conforms to the Contest Entry Requirements set forth herein and you grant Sponsors and their agents the irrevocable and perpetual nonexclusive right to print, publish, reproduce, distribute, modify, create derivative works from, promote, and provide access to any such Entry, in all media throughout the world, and without consideration to you. By submitting an Entry, you represent and warrant: that you are the sole owner of all rights in and to the materials that constitute the Entry; that the Entry is your original work; the Entry has not won previous awards; that the Entry does not violate laws prohibiting copyright infringement, defamation, misuse of trade secrets, invasion of privacy, or other laws; and that use of the Project by Sponsors or Contest Parties (as defined below), including through web posting, will not infringe on the rights of any third parties. You will indemnify and hold harmless, Sponsors and Contest Parties from any claims to the contrary. By submitting an Entry, you agree that your submission is gratuitous and made without restriction, and will not place Sponsors under any obligation, that Sponsors are free to disclose or otherwise disclose the ideas contained in the Entry on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you. You further acknowledge that, by acceptance of your Entry, Sponsors do not waive any rights to use similar or related ideas previously known to Sponsors, or developed by their employees, or obtained from sources other than you.
Except where prohibited by law, entry into the Contest constitutes permission to use winner's name, likeness, contest submission materials, and/or prize information, in any and all media now known or hereinafter invented without territorial or time limitations, for any advertising, promotional, or any other purpose related to the Contest or to use of the Entry by Sponsors or their agents, without further compensation to, or permission from, the winner.
Limitation of Liability: Entrants who violate these Official Rules, tamper with the operation of the Contest, or engage in any conduct that is detrimental to Sponsors, the Contest, or any other entrant (as determined in Sponsors' sole discretion) are subject to disqualification. Sponsors and any of their parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees, and agencies ("Contest Parties") will not be responsible for (1) any late, lost, or misrouted entries or errors in transmission; (2) any disruptions to Internet connection, injuries, losses, or damages caused by events beyond the control of Sponsors; or (3) any printing or typographical errors in any materials associated with the Contest. Contest Parties are not responsible for technical, hardware, software, or telephone malfunctions of any kind and shall not be liable for failed, incorrect, incomplete, inaccurate, garbled, or delayed electronic communications utilized in this Contest that may limit the ability to participate in the Contest. If for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of Sponsors, which corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Contest, the Contest is not capable of being conducted as described in these rules, Sponsors shall have the right, at their sole discretion, to modify and/or cancel the Contest. By entering the Contest or accepting a prize, you agree: (a) to release Contest Parties from any liability whatsoever, and waive any and all causes of action, for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or acceptance, possession, use and/or misuse of any prize or Sponsors' use of Entry in any manner (including without limitation, claims, costs, injuries, losses, and damages related to personal injuries, death damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional) whether under a theory of contract, warranty, tort (including negligence, whether active, passive, or imputed), strict liability, product liability, contribution, or any other theory; (b) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys' fees and court costs.
Governing Law: The Contest will be governed, construed, and interpreted under the laws of the United States. By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant's rights and obligations, or the rights and obligations of the Sponsors in connection with the Contest, shall be governed by, and construed in accordance with, the laws of State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts for San Francisco, California.
